1.            The Promotor
1.1         The Milwaukee Sign up to HEAVY DUTY NEWS - Prize Every Month ("Promotion") is promoted by Techtronic Industries UK Ltd, whose registered address is 22 Market Street, Maidenhead, United Kingdom, SL6 8AD ("Promoter").
1.2         Entry into Promotion is deemed acceptance of this Agreement. Entrants will be subject to the terms of use of the Milwaukee website found here www.milwaukeetool.eu/footer/terms-of-use/
 
2.            ELEGIBILITY
2.1         This Promotion is applicable to residents in a participating European country (Denmark, Sweden, Norway, Finland, France, Spain, Portugal, United Kingdom, Belgium, Netherlands, Germany, Poland, Slovakia, Romania, Hungary, Czech Republic) who are aged 18 years or over at the date of entry. The Promotion will be void and non-applicable where prohibited by law and is subject to all applicable local laws accordingly.
2.2         Employees, officers, and directors of Techtronic Industries (UK) Ltd and its affiliated companies or their family members or anyone else connected in any way with the Promotion or helping to set up the Promotion shall not be permitted to enter the Promotion.
2.3         Entrants are responsible for ensuring that they are entitled to participate and proof of eligibility may be required and prize/s withheld until Promoter is fully satisfied the above criteria are met.
2.4         There is no entry fee and no purchase necessary to enter this Promotion; however, internet connection and mobile data rates may apply to the entrant. The cost of accessing the Promotion website will be dependent on the entrant’s individual internet service provider and shall be the responsibility of the entrant only. Promoter holds no liability towards entrant costs.
2.5         By entering this Promotion, an entrant is indicating his/her acceptance and agreement to be bound by these terms and conditions.
 
3.            HOW TO ENTER
3.1         The Promotion begins at 00:01 on 01/12/2022 and ends at 11:59pm on 30/11/2023 (the “Promotion Period”).

3.3         To enter the Promotion, entrants must follow the instructions set out below;
(i)            All new entrants must complete a form with the following details: first name, surname, email address and trade. Entrants must tick the box to sign up to Heavy Duty News and agree to the T&C’s and privacy policy of the Promotion, which can be viewed by clicking on the link provided at clause 3.2.
(ii)           Once an entrant has completed and submitted the form a confirmation email shall be sent to the email address provided at clause 3.3 (i) and a message shall appear on the screen confirming the form has been completed. 
3.4         For the avoidance of doubt, entrants can enter the Promotion only once using the same e-mail address for the duration of the Promotion Period.
3.5         All existing customers on the Milwaukee database shall automatically be entered into the Promotion and be sent an email confirmation confirming entry into the Promotion. All entrants have the right to withdraw from the Promotion by clicking the ‘Withdraw from Prize Every Month’ button at the bottom of the email.
3.6         Bulk entries made from trade, consumer groups, syndicates or the like will not be accepted. We will not accept cheating in any form including the use of macros or other automated means of entry, masking of identity by manipulating IP addresses, using any false identity or any other behaviour that falls outside the spirit of the promotion (to be determined at our absolute discretion). Any entrant found to be cheating will be excluded.
3.7         Promoter accepts no responsibility for entries not received, deleted, altered or that are invalid, regardless of the reason.
 
4.            PRIZES AND WINNERS ANNOUNCEMENT
4.1         There is a total of 6 (six) prizes available to win throughout the Promotion, as currently made available by the Promoter in the UK market. For the avoidance of doubt, all prize/s are subject to availability. The Promoter reserves the right to modify and/or the prizes at any time for the duration of the Promotion Period.
4.2         For the avoidance of doubt, each monthly prize/s shall not exceed the value of €4,500 EUR available from the Milwaukee Tools range. The Promoter reserves the right to award numerous prize/s up to the value of €4,500 EUR or alternatively one prize up to the value of €4,500 EUR.
4.3         The prize winners will be chosen at random each month using a computer-generated selection by the Promoter on the first working day of each month, and all winners will be contacted by the Promotor no later than the 15th of that month.
4.4         The prize/s will be delivered within 30 working days from the date the winners each provide their postal address to the Promoter.
4.5         The winner will be notified by email where the Promoter will request a delivery address for sending the prize/s. If a winner cannot be contacted or does not claim the prize/s within fourteen (14) days of notification, the Promoter reserves the right to withdraw the prize/s from the winner and select a replacement winner. The Promoter shall have no liability for Winner’s failure to receive notices due to spam, junk e-mail or other security settings or for Winner’s provision of incorrect or otherwise non-functioning contact information.
4.6         The Promoter is not responsible for inaccurate prize details supplied to any entrant by any third party connected with this Promotion and no cash alternative to the prize/s will be offered. The prize/s are not transferable. Prize/s are subject to availability and the Promoter reserves the right to substitute any prize/s with another of similar characteristics without giving notice.
4.7         The Promoter’s decision in respect of all matters to do with the Promotion will be final and no correspondence will be entered into.
 
5.            DATA PROTECTION
Personal data relating to the entrants will be used for the purposes of this Promotion in accordance with the current GDPR legislation and the Promoter’s Privacy Policy found at https://www.milwaukeetool.eu/footer/privacy-policy/
5.1         The Promoter reserves the right to contact all entrants to verify their personal data. For the avoidance of doubt, any entry made in relation to the Promotion as set out at Clause 3 will be deemed to have given consent for the Promotor to process all personal data as defined under Art.4 (1) General Data Protection Regulation 2016/ 679.
 
6.            GENERAL
6.1         Promoter reserves the right to cancel or amend the Promotion and these terms and conditions without notice at any time. Any changes to the Promotion will be notified to entrants as soon as possible by Promoter.
6.2         The Promotion and these terms and conditions will be governed by English law and any disputes will be subject to the exclusive jurisdiction of the courts of England.
6.3         If any provision of these terms and conditions are held invalid by any law, rule, order or regulation of any government, or by the final determination of any court of a competent jurisdiction, such invalidity shall not affect the enforceability of any other provisions not held to be invalid.
6.4         Insofar as is permitted by law, the Promoter, its agents or affiliates will not in any circumstances be responsible or liable to compensate the winner or accept any liability for any loss, damage, personal injury or death occurring as a result of taking up the prize/s except where it is caused by the negligence of the Promoter, its agents or distributors or that of their employees. Your statutory rights are not affected.
